In wake of onslaught of COVID-19, abundant caution is being taken while hearing the matters in Court.

This Court perused the material available on record.

¶13

The petitioner has been arrested in connection with FIR No. 237/2020 of Police Station, Gangashahar, District Bikanerthe offences punishable under Sections 307, 307/34, 384, 384/34, 386, 386/34, 336, 336/34, 435, 435/34, 307/120-B, 384/120-B, 386/120-B, 336/120-B, 435/120-B IPC and Section 5/25 of Arms Act. He has preferred this bail application under Section 439 Cr.P.C.

Counsel for the petitioner submits that the allegation at best against the present petitioner is that the main accused Lalit Tanwar collected weapon from his home.

Counsel for the petitioner further submits that the petitioner was neither present on the spot when the incident happened nor he has been attributed with any allegation of actual incident.

Counsel for the petitioner further submits that charge-sheet in this case has already been filed and the similarly placed co-accused

Mohit @ Vikku has been granted bail by this Court vide S.B. Criminal Misc. Second Bail No.1669/2021 on 02.02.2021.

Learned Public Prosecutor has opposed the bail application.

This Court taking note of the fact that the actual incident is attributed to Lalit Tanwar, Bhanu Pratap Singh, Rahul Pareek @ Jafri and Yogesh Purohit is inclined to grant bail to present petitionerGajendra Singh.

Having regard to the totality of the facts and circumstances of the case as also the fact that conclusion of the proceedings is likely to take some time and without expressing any opinion on the merits of the case, this Court deems it just and proper to grant bail to the accused petitioner under Section 439 Cr.P.C.

Accordingly, this bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioner Gajendra Singh S/o Megh Singh shall be released on bail in connection with FIR No. 237/2020 of Police Station, Gangashahar, District Bikaner provided he executes a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
