Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material on record.

The petitioners, who have been arrested in FIR No.224/2021 registered at Police Station Balesar, District Jodhpur for the offence punishable under Sections 420 & 379 IPC, have preferred this bail application under Section 439 Cr.P.C.

Learned counsel for the petitioners submitted that allegation against the petitioners is that they have withdrawn money by using the fake ATM card. Learned counsel for the petitioners further submitted that all the petitioners are in judicial custody since 09.10.2021 and no recovery in the present case has been held from any of the petitioners. The reference of recovery from the petitioners as mentioned in the order of Sessions Court dated 27.10.2021 is in relation to the another case of similar nature and not in the present case. The offence are triable by a Magistrate, further investigation and trial may take its own time. Therefore, he prays to enlarge the petitioners on bail.

Mr. Shrawan Bishnoi, learned Public Prosecutor has opposed the bail application.

Having regard to the contentions made by the learned counsel for the petitioners and the learned Public Prosecutor, as also the material on record, particularly looking to the fact that the offence are triable by a Magistrate and all the petitioners are in judicial custody since 09.10.2021, without expressing any opinion on the merits of the case, this Court deems it just and proper to grant bail to the accused petitioners under Section 439 Cr.P.C.

Accordingly, this bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioners Mangal Singh S/o Shri Ramprakash, Atin Bhaskar S/o Ram Kumhar, Golu S/o Ramesh and Rohit Bhaskar S/o Ram Murti Bhaskar shall be released on bail in connection with FIR No.224/2021 registered at Police Station Balesar, District Jodhpur provided each

of them execute a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
