Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the case diary.

The petitioner has filed this anticipatory bail application under Section 438 CrPC in connection with FIR No.11/2019 registered at Police Station Chunawadh, Sri Ganganagar for offence under Sections 420, 467, 468, 471 & 120-B of IPC.

Learned counsel for the petitioner has submitted that the coaccused Gurbachan Singh who was J.En has been granted bail under Section 438 Cr.P.C. by this Court vide order dated 16.07.2021. The petitioner is said to be A.En and has been retired much prior to filing of the present FIR. The Petitioner is ready to co-operate with the investigation.

In this view of the matter and having regard to the facts and circumstance of the case, particularly, looking to the fact that co-

ordiante Bench of this Court has already granted bail to the coaccused Gurbachan Singh under Section 438 Cr.P.C. and no custodial investigation is required, I am of the view that the petitioner deserves grant of anticipatory bail.

Accordingly, this bail application under Section 438 CrPC is allowed and it is ordered that in the event of arrest of petitioner Parveen Kumar Gakher S/o Shri Govind Lal Gakher in connection with FIR No.11/2019 registered at Police Station Chunawadh, Sri Ganganagar, he shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with sound & solvent two sureties of Rs.25,000/- each, to the satisfaction of concerned Investigation Officer, subject to the following conditions:

That he shall not leave India without prior permission by concerned trial court;

That he shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police office;

3.That he shall make himself available for interrogation by a police officer as and when required.
