This 2^nd bail application has been filed under Section 439 Cr.P.C. in connection with FIR No. 340/2020 registered at Police Station Singhana, District Jhunjhunu for the offences under Sections 457 and 380 of IPC.

Learned counsel for the petitioner submits that first bail application of the petitioner was dismissed as withdrawn with liberty to file fresh one after filing of charge-sheet and now the charge-sheet has been filed. He further submits that the petitioner is in judicial custody since 18.03.2021. Hence, the accusedpetitioner may be released on bail.

Learned Public Prosecutor has strongly opposed the bail application. As per rejection bail order, the petitioner has criminal antecedents of the four cases.

Considering the submissions made by learned counsel for the petitioner and taking into consideration overall facts and circumstances of the case, but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to enlarge the petitioner on bail.

Consequently, the 2^nd bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Ramkishan @ Kaliya S/o Shri Ram shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/with two sureties of Rs.25,000/- each (out of which one surety shall be resident of Jhunjhunu District) to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
