The present criminal appeal under Section 14(2) (A) of the SC/ST (Prevention of Atrocities) Act has been filed in connection with FIR No.47/2021 registered at Police Station Sarund, District Jaipur (Rural) for the offences under Sections 323, 341, 379, 143 IPC and Section 3-1 (R) (S) 3-2(va) of SC & ST (Prevention of Atrocities) Act.

Learned counsel for the appellant submits that the appellant has been falsely implicated in this matter. He is behind the bars since 17.06.2021. Charge-sheet has been filed against the appellant. Learned counsel for the appellant also submits that after investigation, offence has not been found proved under Section 379 IPC and conclusion of trial may take long time.

Keeping in view the facts and circumstances of the case, it would be just and proper to release the appellant on bail.

This appeal is allowed and the order dated 21.06.2021 passed by the learned Additional Session Judge No.2, Jaipur Metropolitan-I is quashed and set-aside. It is directed that accused appellant- Vijay Singh S/o Shri Gaje Singh Rajput shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that he shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
