The present criminal appeal under Section 14A of the SC & ST (Prevention of Atrocities) Act has been filed in connection with FIR No.427/2019 registered at Police Station Chandwaji, Jaipur (Rural) for the offences under Sections 302 and 120B of IPC and under Sections 3(2)(V), 3(2)(v-a) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Counsel for the appellant submits that appellant has been wrongly implicated in this case. Learned counsel for the appellant also submits that appellant is behind the bars since 27.10.2019. Similarly situated co-accused Akbar, Allauddin, Afsar were en-

larged on bail by the co-ordinate Bench of this Court. Conclusion of trial will take time.

Learned Public Prosecutor as well as learned counsel for the complainant have opposed the appeal.

Keeping in view the facts and circumstances of the case, it would be just and proper to release the appellant on bail.

This appeal is accordingly allowed and the order dated 16.09.2020 passed by the learned Special Judge SC & ST (POA) Act Cases, Jaipur Metro-First is quashed and set-aside. It is directed that accused appellant- Anju Devi Wife Of Poonam Goyar shall be released on bail provided she furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that she shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
