Learned counsel for the petitioner No.1-Mohar Singh seeks permission of the Court to withdraw this bail application with liberty to the petitioner No.1-Mohar Singh to surrender before the concerned Court.

Permission as sought for is granted.

This bail application of petitioner No.1-Mohar Singh is dismissed as withdrawn with liberty as prayed for.

However, if petitioner No.1-Mohar Singh surrenders himself and files bail application before the concerned Court, it is expected from the Court concerned to decide the bail application of the petitioner No.1-Mohar Singh preferably on the same day as per law.

The present bail application has been filed under Section 438

Cr.P.C. in connection with FIR No.103/2021 registered at Police Station Sadar Karauli, for the offence(s) under Sections 341, 323, 325, 307, 504 and 34 IPC.

On consideration of submissions made on behalf of the respective parties and the material made available for my perusal as well as the evidence collected during investigation, which has been produced before me by way of case diary but without expressing any final opinion on the merit and de-merit of the case, I am inclined to grant benefit of anticipatory bail to the accusedpetitioner No.2-Smt. Sushila and petitioner No.3-Hemraj.

Consequently, the application for anticipatory bail is partly allowed.

The SHO/IO/Arresting Authority, Police Station Sadar Karauli in FIR No.103/2021 is directed that in the event of arrest of the petitioner No.2-Smt. Sushila W/o Mohar Singh and petitioner No.3-Hemraj S/o Chiranji , they shall be released on bail, provided each of them furnishes personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to his satisfaction on the following conditions:-

(i) that the petitioner No.2-Smt. Sushila and petitioner No.3-Hemraj shall make themselves available for interrogation by a police officer as and when required; (ii) that the petitioners No.2 and 3 shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or any police officer, and

(iii) that the petitioners No.2 and 3 shall not leave India without previous permission of the court.
