The present criminal appeals under Section 14(A) (2) of the SC/ST (Prevention of Atrocities) Act have been filed in connection with FIR No.158/2021 registered at Police Station Jhalawar Sadar, District Jhalawar for the offences mentioned therein.

Learned counsel for the accused appellants submits that the appellants have been falsely implicated in the present case as they have nothing to do with the alleged incident. Accused appellants have not been named in the FIR. Counsel further submits that the accused appellants are behind the bars since long. Conclusion of the trial may likely to take time. Hence, the accused appellants be released on bail.

Learned Public Prosecutor assisted by learned counsel for the complainant have opposed the appeals.

Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the appellants on bail.

The impugned order passed by the learned Court below is set-aside, these appeals are allowed and it is directed that accused appellants Harisingh S/o Vijaysingh, Satvir Singh S/o Narayan Singh and Mahendra Kumar S/o Ramgopal shall be released on bail provided each of them shall furnish a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/(Rupees Twenty Five Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that they shall appear before that Court and any Court to which the matter is

transferred, on all subsequent dates of hearing and as and when called upon to do so.
