The present criminal appeal under Section 14-A of the SC/ST Act has been filed in connection with FIR No.287/2021 registered at Police Station Kotwali, District Dholpur for the offences under Sections 323, 341, 427, 504, 506 IPC read with Section 3(1)(r) & 3(1)(s) of the SC/ST (Prevention of Atrocities) Act.

Learned counsel for the appellant submits that the appellant has been falsely implicated in this matter. Learned counsel further submits that appellant is in judicial custody since long and conclusion of trial may take long time, hence the accusedappellant be released on bail.

Learned Public Prosecutor and learned counsel for the respondent have opposed the appeal.

Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the appellant on bail.

The order dated 15.07.2021 passed by the learned Special Judge, SC/ST (POA) cases, Dholpur (Raj.) is quashed and setaside and this appeal is accordingly allowed and it is directed that accused appellant Raju S/o Praveen shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/(Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that he shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
