After arguing the matter for quite sometime, learned counsel for the appellant wants to withdraw this appeal with liberty to oppose the application for temporary injunction before the trial court.
Learned counsel for the appellant submits that reply to the application for temporary injunction has been filed, however, arguments on the temporary injunction are not been heard, hence the trial court may be directed to hear and decide the application for temporary injunction expeditiously.
In view of the above, the appeal is dismissed as withdrawn with liberty to the appellant to contest the application for temporary injunction before the trial court and it is expected that same shall be decided expeditiously.
