The appeal has come up on the application to not press this appeal in view of compromise.
Learned counsel for the appellant submits that the parties have entered into compromise out of Court and in view of the above compromise, the appellant has vacated the suit premise and has delivered the vacant possession to the respondents. Thus, the appellant does not want to press this first appeal.
Learned counsel for the respondents does not oppose the application and admits to receive the vacant possession of suit property.
In view of above, the application is allowed and the present first appeal is dismissed as not pressed.
