Heard learned counsel for the applicant as well as learned counsel for the complainant through Video Conferencing.

Learned counsel for the applicant has submitted that the applicant was on bail during trial. In fact applicant is a friend of co-convict, Rohit. Victim was having love affair with co-convict, Rohit. Allegation against the applicant is that he had given Rs.4,000/- to his friend Rohit to enable him to elope with the victim/prosecutrix. False allegation of threats have been levelled against the applicant by the prosecutrix under the influence of her

parents. There are lot of telephonic conversations between the coconvict, Rohit and the prosecutrix.

the applicant have opposed the application.

Keeping in view the fact that the applicant was on bail during trial and the other facts and circumstances of the case, it would be just and expedient to suspend the sentence of the applicant during pendency of the appeal.

Accordingly, without expressing any opinion on merits of the case, the application is allowed. Sentence of the applicant shall remain suspended during pendency of the appeal. The applicant be admitted on bail subject to satisfaction of the trial Court.
