Petitioner has filed this writ petition under Article 226 of The Constitution of India seeking fourth regular parole for forty days.

Heard learned counsel for the petitioner through video conferencing.

Learned counsel for the petitioner has submitted that on two occasions petitioner had surrendered before the jail authorities after availing the parole period. However, on one occasion, petitioner could not surrender before the jail authorities on the

last day of his parole as the vehicle on which the petitioner was travelling had developed some fault. Petitioner had surrendered before the jail authorities on the next day i.e. on 6.5.2018 at 7.15 a.m., although, he was required to surrender on 5.5.2018. The Social Justice Empowerment Department has recommended the case of the petitioner for release on parole vide its report Annexure-R/4.

Learned State Counsel has opposed the petition.

Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the petitioner on parole.

Accordingly, this petition is allowed. Respondent no.3 is directed to release the petitioner on fourth regular parole for forty days subject to its satisfaction.
