Facts of the case are that in the year 1988, one Tara Chand was appointed as Beldar in Forest Department, on daily wages basis and subsequently in the year 1990, his services were regularized. Thus, he got substantive status in the Forest Department. While in service, he died on 7.11.2017. The respondent Mamta Devi filed writ petition alleging that Tara Chand, husband of the petitioner, during his life time earlier married with 'Lali Devi' and out of the wedlock two children born. Thereafter first wife of late Tara Chand was lost in the year 2002, who was searched for quite a long time, but could not be found. In the year 2007, Tarachand married with the writ petitioner and out of the wedlock, two children born. On account of death of Tara Chand, the respondent prayed for compassionate appointment as well as family pension and remaining service benefits of late Tara Chand. She annexed with the writ petition nomination papers of Tara Chand, where the present petitioner was made nominee of late Tara Chand for family pension and compassionate appointment etc. However, the appellants took the stand that since there was a dispute between children born out of the wedlock of the first wife and the writ petitioner, therefore, a decision to grant family pension could not be taken.
