Petitioner has filed the petition under Article 226 of the Constitution of India seeking first regular parole of twenty days.

Learned counsel for the petitioner has submitted that the petitioner has undergone more than five years of sentence. Jail conduct of the petitioner is satisfactory. Social Justice and Empowerment Department has recommended the case of the petitioner for parole.

Learned State Counsel has opposed the petition. However, learned State Counsel has placed on record the report of Social Justice and Empowerment Department and as per the said report, the case of petitioner for his release on parole has been recommended by the Department.

Keeping in view the facts and circumstances of the case, it would be just and expedient to order release of the petitioner on first regular parole for twenty days.

Accordingly, this petition is allowed. Petitioner be admitted to first regular parole for twenty days subject to the satisfaction of the respondent no.3.
