After arguing at some length, learned counsel for the petitioner wants to withdraw the present misc. petition with liberty to press his bail application which is pending before this Court.
Accepting the prayer of learned counsel for the petitioner, the present misc. petition is dismissed as withdrawn.
However, it is made clear that on account of withdrawal of this petition, it would not come in a way for the decision of 438 bail application and it will be decided on its own merits.
