This Criminal Misc. Bail Application has been brought under Section 439 of Cr.P.C. seeking regular bail in connection with F.I.R. No. 158/2020 registered with Police Station Bandikui, District Dausa, for the offence punishable under Section 379 of IPC.

It has been submitted on behalf of the petitioner that the case is triable in the Magistrate Court. Charge-sheet has been filed after investigation under Section 379, 435 of IPC. The other criminal cases which are shown to be pending against petitioner are false and he has already been acquitted in other criminal cases and in this case, he was summoned through production warrant. He has been falsely involved in this case.

Learned Public Prosecutor has opposed the bail application and has submitted that there are eight criminal cases of similar nature are pending against the petitioner registered in different police stations for different offences.

Heard learned counsel for the petitioner as well as learned Public Prosecutor, perused the material available on record. 5. On consideration of the arguments/submissions of both the parties, perusal of material available on record, looking to the fact that eight other criminal cases of similar nature are pending against the petitioner, but without commenting upon detailed merits of the case, no ground is made out to allow the bail application. Hence, it deserves to be rejected.

Accordingly, the bail application is dismissed.
