This Criminal Misc. Bail Application has been brought under Section 439 of Cr.P.C., seeking regular bail in connection with FIR No.285/2020 registered at Police Station Pragpura, District Jaipur (Rural) for offence under Sections 143, 341, 323 and 308 of IPC wherein during investigation offence has been found under Sections 307, 323, 341 & 34 of IPC.

It has been submitted on behalf of the petitioner that it is a case of version and cross version. As per the charge-sheet, it has been specifically mentioned that opposite party was the aggressor and first assault was committed by the opposite party. There are two injury reports on the record. In first report injury was described as grievous injury but not dangerous to life. Thereafter,

this injury was described as dangerous to life. Hence, medical report is also contradictory. Charge-sheet has been filed. Conclusion of trial will take considerable time. Co-accused Shivkaran @ Sheokaran S/o Sriram Gurjar has been released on bail by Co-ordinate Bench of this Court vide order dated 14.10.2020.

Learned Public Prosecutor and learned counsel for the complainant have opposed the bail application. Learned Public Prosecutor has submitted that two other criminal cases are pending, one FIR No.168/1992 under Sections 147, 341 and 323 IPC and second FIR No.261/2009 under Sections 279 and 304-A of IPC.

On consideration of arguments/submissions of both the parties, material on record and overall facts and circumstances of the case, but without commenting upon detailed merits of the case, this Court deems it fit to enlarge the accused on bail. 5. Therefore, this bail application is allowed. Accused-petitioner Durgaprasad S/o Shriram shall be released on bail in FIR No. 285/2020 registered at Police Station Pragpura, District Jaipur (Rural), if he is not wanted in any other case, provided he furnishes a personal bond in the sum of Rs.1,00,000/- (One Lakh) together with two sureties in the sum of Rs.50,000/- (Fifty Thousand) each to the satisfaction of learned trial court with the stipulation that he shall appear before that Court or any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
