This Criminal Misc. Bail Application has been brought under Section 439 of Cr.P.C., seeking regular bail in connection with F.I.R. No. 400/2017 registered at Police Station Ramgarh (Alwar) for offence under Sections 420, 406 and 395 IPC.

Heard learned counsel for the accused petitioner through video conferencing and perused the record.

It has been submitted by learned counsel for the petitioner that he has been falsely implicated in this case. No recovery has been made from him. Similarly situated co-accused Jamshed, Arshad, Shahroop Khan and Vaheed Khan have been granted benefit of bail. Trial of the case will take time.

Learned Public Prosecutor has opposed the bail application.

I have considered the contentions.

On consideration of arguments/submissions of both the parties, perusal of material on record and looking to the facts and circumstances of the case, but without commenting upon detailed merits of the case, this court deems it fit to enlarge the accused on bail.

Therefore, the bail application is allowed. Accused-petitioner Shoukin S/o Shri Suleman shall be released on bail in FIR No. 400/2017 registered at Police Station Ramgarh (Alwar) , if he is not wanted in any other case, provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac Only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.

It is made clear that if the petitioner repeats the offence, State would move application for cancellation of bail before the concerned Court.

Copy of this order be sent to the concerned SHO for recording this condition in the village crime report, so that in the event of petitioner’s repeating the offence, SHO can move the court for cancellation of bail.
