Heard Mr. Ajay Kumar Jain, learned counsel for the petitioner and Mr. Sneh Deep Khyaliya, learned counsel for the complainant, through video calling as well as learned Public Prosecutor, who is present in the Court.

The present second bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.241/2019 Registered at Police Station Banipark Distt. Jaipur for the offences under Sections 420, 464, 467, 468, 471 & 120-B of IPC.

Counsel for the petitioner submits that the petitioner has been falsely implicated in this matter and the petitioner has handed over the demand draft of Rs.12,60,000/- in the name of complainant to the counsel for the complainant on 09.06.2020. Counsel further submits that the petitioner is in custody since 05.02.2020.

Counsel for the complainant has not disputed the fact and further submits that the complainant has received the aforesaid amount under protest only for the purpose of grant of bail.

Learned Public Prosecutor has opposed the bail application.

Considering the material on record and taking into account the facts and circumstances of the present case and also considering the fact that the case is triable by First Class Magistrate and also the period of custody and without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to regular bail subject to satisfaction of the trial Court. Office is directed to send a copy of this order to the concerned trial Court through e-mail/fax, for necessary compliance.
