This application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with F.I.R. No.200/2019, Police Station Vallabhnagar, Udaipur for the offences under Sections 447, 143, 341, 323, 325 & 308 of IPC.

Heard learned counsels for the parties. Perused the material available on record.

It is submitted on behalf of the petitioners that the allegation of inflicting the injuries are on the co-accused Mohan Lal & Sukh Lal @ Situ Dangi. The co-accused Mohan Lal & Sukh Lal @ Situ Dangi have already been granted regular bail by this Court vide order dated 19.12.2019 and the case of the present petitioners are not distinguishable from the case of the co-accused who have already been released on bail by this Court.

application but they are unable to distinguish the case of the present petitioners vis-a-vis the case of the co-accused persons who have been enlarged on bail.

Having regard to the facts and circumstances of the case and upon a consideration of the arguments advanced and considering the fact that the case of the present petitioners are identical to coaccused aforesaid who have been enlarged on regular bail by this Court and the present petitioners are ladies of 56 years and 28 years of old, this Court is of the opinion that the petitioners are also entitled for the grant of bail under Section 438 Cr.P.C.

Accordingly, the present anticipatory bail application is allowed and it is directed that in the event of arrest of petitioners (1)Logari W/o Mohan Dangi, and (2)Laxmi W/o Ramesh Dangi in connection with F.I.R. No.200/2019, Police Station Vallabhnagar, Udaipur, the petitioners shall be released on bail; provided each of them furnish a personal bond in the sum of Rs.50,000/- (Rupees: Fifty Thousand Only) along with two sureties of Rs.25,000/(Rupees: Twenty Five Thousand Only) each to the satisfaction of the concerned Investigating Officer/S.H.O. on the following conditions :-

(i) that the petitioners shall make themselves available for interrogation by a police officer as and when required;

(ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer; and

(iii) that the petitioners shall not leave India without previous permission of the court.
