This bail application has been filed under Section 439 CrPC seeking regular bail in FIR No. 581/2019 registered at Police Station, Kotwali, Distt.Jhunjhunu for the offence under Section 380 IPC and Section 66 of IT Act.

Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this matter. The petitioner is in judicial custody since 20.12.2019 and conclusion of trial is likely to take long time. The alleged offence is triable by a Magistrate. He further submits that investigation has been completed and challan has been filed, hence the petitioner may be enlarged on bail.

Learned PP appearing for the State has opposed the same and submits that 10 other cases of similar nature are said to have been registered against the petitioner in different States of

the country. The petitioner is a habitual offender, hence he should not be enlarged on bail.

Taking into consideration the overall facts and circumstances of the case and more particularly the number of similar nature of cases registered against the petitioner, I do not think it just and proper to enlarge the petitioner on bail.

Accordingly the bail application filed by the petitioner

under Section 439 CrPC is hereby dismissed.
