Heard learned counsel for the petitioner and also learned Public Prosecutor and perused the factual report submitted by the Investigating Officer, it is noticed that there are cross-cases registered with regard to the injuries caused on the petitioner, which are gun-shot injuries. Allegations against the petitioner is of possessing “lathi” while the injuries caused on the complainant are gun-shot injuries. The challan has already been filed in the matter.

Taking into consideration aforesaid facts and the cross-cases and that the charge-sheet has already been filed, but without commenting on the merits of the case, I deem it fit to release the accused petitioner on bail.

Therefore, this bail application is allowed and it is ordered that the accused-petitioner-Rajmohammad @ raja S/o Shri Jahangir be released on bail under Section 439 Cr.P.C. in connection with aforesaid FIR provided he furnishes a personal bond of Rs.20,000/- with one surety in the like amount to the satisfaction of the concerned Magistrate with the stipulation that they shall comply with all the conditions laid down under Section
