The petitioner has filed this bail application under Section 439 Cr.P.C. in connection with FIR No.170/1995 registered at Police Station Galtagate, District Jaipur Metropolitan for the offences under Sections 363, 366, 366-A, 376, 372 & 109 IPC.

Heard learned counsel for the accused-petitioner and learned Public Prosecutor appearing for the State and carefully scanned the relevant material made available on record.

Learned counsel for accused-petitioner submits that an FIR was registered in the year 1995 at the behest of wife of the petitioner as there were having strange relations between the petitioner and his wife who left his house. A complaint was lodged with regard to his sister-in-law who is already married and is 40 years of age. The petitioner has been arrested after 25 years.

Learned Public Prosecutor has opposed the bail application.

Taking into consideration the nature of allegation/s but without expressing any opinion on the merits and demerits of the case, I deem it appropriate to enlarge the accused-petitioner on bail.

Therefore, this bail application is allowed and it is directed that accused-petitioner namely, Kanji @ Kanaram S/o Shri Ramnath Mali shall be released on bail under Section 439 Cr.P.C. in connection with aforesaid FIR, provided he furnishes a personal bond in the sum of Rs.20,000/- (Rupees Twenty thousand only) together with one surety in the like amount to the satisfaction of the concerned Magistrate with the stipulation that he shall comply with all the conditions laid down under Section 437(3) Cr.P.C.
