All the above three bail applications shall stand decided by this common order as they arise out of common F.I.R.

The present bail applications have been filed under Section 439 of Cr.P.C. on behalf of the petitioners who are in custody in connection with F.I.R. No. 694/2019, Police Station Mahamandir, District Jodhpur for the offences under Sections 379 & 411 of I.P.C.

Heard learned counsel for the petitioners as well as learned Public Prosecutor and the counsel for the complainant. Perused the material available on record.

It is submitted by learned counsel for the petitioners that the offences alleged against the petitioners are triable by Magistrate. The recovery from the petitioners has already been effected. The petitioners are facing incarceration for more than 15 days. The conclusion of trial will take sufficiently long time, therefore, it is prayed that the petitioners may be enlarged on bail.

Learned Public Prosecutor as well as learned counsel for the complainant oppose the bail.

Having regard to the facts and circumstances of the case and upon a consideration of the arguments advanced, this Court is of the opinion that the bail applications filed by the petitioners deserve to be accepted.

Consequently, the bail applications are allowed. It is ordered that the accused-petitioners (1) Mohd. Irfan S/o Mohammed Iqbal Madawat, (2) Pankaj @ Chandu S/o Ashok Chandel and (3) Ganga

Ram S/o Sh. Mukana Ram arrested in connection with F.I.R. No. 694/2019, Police Station Mahamandir, District Jodhpur shall be released on bail; provided each of them furnishes a personal bond of Rs. 50,000/- with two surety bonds of Rs. 25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
