In wake of onslaught of COVID-19, lawyers have been advised to refrain from coming to the Courts.

This Court perused the material available on record.

¶14

The petitioner has been arrested in connection with FIR No.382/2015 of Police Station Pilibanga, District Hanumangarh for the offences punishable under Sections 420 & 120-B IPC and Sections 4, 5 & 6 of Cheat and Fund Act. He has preferred this interim bail application under Section 439 Cr.P.C.

Learned counsel for the petitioner submits that the petitioner is seeking interim bail due to heart disease.

Learned Public Prosecutor, while opposing the bail application, has shown to this Court a report, which reflects that

the petitioner has not only recovered from the ailment, but has also been discharged from the SMS Hospital, Jaipur, and thus, at this stage, there is no document, which could suggest a ground for grant of interim bail to the present petitioner.

In view of the above, this Court is not inclined to grant interim bail to the present petitioner.

Consequently, the present interim bail application is dismissed. However, in case the petitioner or his family members want to take medical help for the petitioner, in custody, then the same shall be arranged by the Superintendent of the concerned Jail, strictly in accordance with law.
