Learned counsel for the applicant has submitted that the applicant is in custody since 18.2.2016. No specific overt act has been attributed to the applicant vis-à-vis the deceased. Sentence of similarly situated convicts has been suspended by this court. Applicant is not involved in any other criminal case.
Learned State counsel has opposed the application.
Keeping in view the facts and circumstances of the case, it would be just and expedient to suspend the sentence of the applicant during the pendency of the appeal.
Accordingly, without expressing any opinion on the merits of the case, application is allowed. Sentence of the applicant shall

remain suspended during the pendency of the appeal. Applicant be admitted to bail subject to satisfation of the Trial Court.
