Learned counsel for the applicant/appellant has submitted that the applicant/appellant was on bail during trial. Now, applicant/appellant is in custody for the last more than six months after conviction. Applicant/appellant had remained in custody for about one year, during trial. Applicant/appellant is not involved in any other criminal case. Recovery of Rs.15,000/- has been falsely foisted on the applicant/appellant. Co-accused Bharat Singh, Nihal Singh and Rakesh Yadav were identified during trial as the persons, who had committed the murder of deceased Rajesh Kumar Sharma.

Learned State counsel who is assisted by counsel for the complainant has opposed the application.

Keeping in view the facts and circumstances of the case, it would be just and expedient to suspend the sentence of the applicant/appellant, during the pendency of the appeal.

Accordingly, application is allowed. Sentence of the applicant/appellant shall remain suspended during the pendency of the appeal. Applicant/appellant be admitted to bail subject to satisfaction of the trial court.
