Learned counsel for the appellant has submitted that this appeal be treated as a regular appeal against the judgment/order passed by the trial Court, whereby, respondent Nos. 3 to 5 were acquitted of the charges framed against them. Learned counsel has placed reliance on the decision of the Hon’ble Supreme Court in Naval Kishore Mishra Versus State of U.P. & Ors in Criminal Appeal No. 979 of 2019 (Special Leave Petition (Crl.) No. 1642 of 2018) decided on 05.07.2019.
Accordingly, office is directed to register this case as D.B. Criminal Appeal.
Learned counsel for the appellant is directed to file amended cause title.
