In a similar case ( Saraswati vs. State of Rajasthan & Ors. , D.B. Special Appeal (Writ) No.920/2018), which arose out of the same common judgment which is subject matter of the present appeal. The Court had rejected the appeal and affirmed the impugned judgment on 07.08.2019.
Following the judgment in the case of Saraswati (supra), the present appeal is held to be unmerited and it is accordingly dismissed.
