The questions involved in bunch of these cases is the vires of Rule 18A(4)(ii) and 18(A)(vi) of the Pre Conception and Pre Natal Diagnostic Techniques (Prohibition of Sex Selection) Rules, 1996 (hereinafter referred to as ‘the Rules of 1996’). Additionally, Sections 22 and 23 of the Pre Conception and Pre Natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994 (hereinafter referred to as ‘the Act of 1994’) have been challenged.

At the outset, this Court notices that in the judgment, reported as Federation of Obstetrics and Gynecological Societies of India Vs. Union of India & Ors. (AIR 2019 SC 2214), the validity of Section 23 has been upheld. Therefore, the challenge to the Section fails.

As far as the challenge to the Rule is concerned, the Division Bench judgment in D.B. Civil Writ Petition No.6482/2017, Sonological & Imaging Socity Vs. Union of India & Anr. and connected case D.B. Civil Writ Petition No.5995/2014, Chandrawal

Hospital & Research Centre Vs. Union of India & Anr. , decided on 12.07.2019, upheld the validity of the Rule and clarified that if a doctor or a medical practitioner is involved in a criminal case, that per se would not bar a Center (so long as it is not involved in a criminal case) securing registration or renewal.

In these circumstances, the ratio in the case of Sonogical & Imaging Society (supra) would apply.

The Rule accordingly is held to be valid.

In the event of any applicant (including a doctor applicant) having been acquitted during the pendency of these proceedings, the bar under Rule 18A of the Rules of 1996, would obviously not apply. If an application is made, that would be considered on its merits and appropriate orders be made by the State.

The writ petitions and appeals are dismissed – subject to the above condition.
