The present writ petition has been filed seeking a direction to the respondents to consider the Sports Participation Certificate (Annx.5) of the petitioner while considering her candidature for appointment on the post of Physical Training Instructor Grade – III.

This Court while issuing notices on 16.11.2018 passed the following order :-

“In the meanwhile, the respondents are directed to take into consideration the certificate Annexure-5 sought to be relied on by the petitioner for awarding of marks in connection with recruitment to the post of PTI Gr.-III. However, the said consideration shall be made in accordance with law and the same

would remain subject to the final outcome of the present writ petition.”

Learned counsel for the petitioner submits that in compliance

of the directions issued by this Court on 16.11.2018, the certificate submitted by the petitioner has been considered and the final result of the PTI Grade – III Examination, 2018 has been declared on 26.09.2019. The name of the petitioner is falling in the merit list prepared for the post of PTI Grade- III and thus, she is entitled for appointment on the post of PTI Grade – III.

In these circumstances, the writ petition is allowed. The respondents are directed to accord appointment to the petitioner on the post of PTI Grade – III pursuant to the advertisement RSMSSB No. 09/2018 if she is otherwise found eligible for being appointed on the said post.
