The present misc. petition has been filed against the order dated 01.03.2019 passed by learned Session Judge, Churu, wherein the application preferred by the prosecution under Section 311 Cr.P.C. has been allowed and PW-13 Dr. Manoj Kumar Sharma has been directed to reappear for the evidence before the trial Court.
Mr. R. K. Charan, learned counsel for the petitioner submits that he does not want to press the present misc. petition. However, he seeks liberty to raise all the grounds regarding the veracity of the document which is sought to be proved by the prosecution with the aid and testimony of PW-13 before the trial Court.
Accordingly, the present misc. petition is dismissed as not pressed with the opportunity to the petitioner to raise all the
