The petitioner has been arrested in connection with FIR No. 457/2018 of Police Station Jawahar Nagar, District Sri Ganganagar for the offences punishable under Sections 8/18 & 29 of the N.D.P.S. Act.

Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record

It is submitted on behalf of the petitioner that after dismissal of the second bail application of the petitioner on 18.01.2019, the statement of the Seizure Officer has been recorded before the learned trial court. Learned counsel submits that the recovery of contraband, which was below commercial quantity, was made from the co-accused Jitendra Singh, who has been enlarged on bail vide Order dated 20.08.2018. No recovery of contraband has

been made from the possession of the petitioner. Thus, the case of the petitioner is on better footings to that of co-accused Jitendra Singh. The petitioner is behind the bar since August, 2018. The conclusion of trial will take sufficiently long time, therefore, it is prayed that the petitioner may be enlarged on bail.

Learned Public Prosecutor opposes the bail.

Having regard to the totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to grant bail to the accused petitioner under Section 439 of Cr.P.C.

Accordingly, the third bail application filed under Section 439 of Cr.P.C. is allowed and it is directed that petitioner – Vishal Singh s/o Rood Singh shall be released on bail in connection with FIR No. 457/2018, Police Station Jawahar Nagar, District Sri Ganganagar provided he furnishes a personal bond in a sum of Rs. 50,000/- with two sound and solvent sureties of Rs. 25,000/each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial
