The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No. 67/2019 Registered at Police Station Bani Park, Jaipur (Raj.) for the offences under Sections 420, 467, 468, 471 & 120B of I.P.C.

Counsel for the petitioner submits that the petitioner has been falsely implicated in this matter. Counsel further submits that there is business transaction between the petitioner and the complainant and the complainant has deposited Rs.1,20,00,000/in the bank account of the petitioner out of which the petitioner has already refunded an amount of Rs.1,00,00,000/- to the complainant through bank transaction and for remaining amount, the petitioner has already given a cheque of Rs.28,40,000/- to the

complainant. Counsel further submits that the co-accused-Rakesh Kumar Goyal has already been released on bail by this court vide order dated 19.06.2019 in S.B. Criminal Misc. Bail Application No.7901/2019

Learned Public Prosecutor assisted by counsel for the complainant has opposed the bail application and submitted that the cheque of Rs.28,40,000/- given by the petitioner has already been dishonoured.

The Investigating Officer-Narendra Singh who is present in the court has confirmed the fact regarding refund of Rs.1,00,00000/- by the petitioner to the complainant through bank transaction. 5. Heard counsel for the parties and perused the record. 6. Considering the contentions put-forth by the counsel for the parties and taking into account the facts and circumstances of the case and without expressing any opinion on the merits of the case, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner- Ganesh Ingole S/o Keshav Rao shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
