The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in judicial custody in connection with F.I.R. No. 152/2014 Police Station Jhab District Jalore for offences under Sections 8/15 and 8/29 of NDPS Act.

Learned counsel for the petitioner submits that co-accused Hukma Ram @ Hakam Singh has been granted bail by this Court vide order dated 26.04.2019. The case of the accused-petitioner is similar to that of co-accused Hukma Ram @ Hakam Singh. The allegation for the offence under Section 29 of the NDPS Act has been leveled against both the accused. Challan has already been filed. The accused-petitioner may also be granted bail on the ground of parity.

Learned Public Prosecutor has opposed the bail application but admits that the case of the co-accused Hukma Ram @ Hakam Singh and accused-petitioner is similar.

Heard and considered the arguments advanced by the learned counsel for the petitioner and learned Public Prosecutor.

Having regard to the facts and circumstances of the case, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted.

Consequently, the bail application is allowed. It is ordered that the accused-petitioner-Umesh @ Inderjeet son of Shri Kalu Ram arrested in connection with F.I.R. No.152/2014 shall be released on bail; provided he furnishes a personal bond of Rs.50,000/- and two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
