Petitioner has filed this 5th petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in F.I.R. No.563/2016 registered at Police Station Bassi, District Jaipur for offence under Sections 323, 341, 143, 379 Indian Penal Code, 1860 (hereinafter referred to as 'IPC'). Later on chargesheet has been filed under Sections 302, 307, 325, 323, 341, 147, 148, 149 IPC.
Heard.
Earlier bail petition filed by the petitioner was dismissed on merits by this court vide order dated 25.03.2017 keeping in view the fact that the statement of the deceased was recorded before his death and in the said statement he had stated that

he had been inflicted injuries by the petitioner, Ramji Lal and Prahlad.
During the course of arguments, it has transpired that the trial is now at the fag end and only two prosecution witnesses remain to be examined.
