Petitioner has filed this petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in F.I.R. No. 77/2018 registered at Police Station Kisanganj, Ajmer, for offences under Sections 323, 341, 307 of Indian Penal Code, 1860.
Learned counsel for the petitioner has submitted that the petitioner is in custody since 08.03.2018. Similarly situated co-acussed Mithun and Munna Khan have been granted bail by co-ordinate Bench of this Court.
Learned State Counsel, has opposed the petition.
Since, co-accused have been granted bail by co-ordinate Bench of this Court, on the ground of parity and without expressing any opinion on merits of the case, this petition is allowed. Petitioner be admitted to bail subject to satisfaction of the Trial Court.
