The present second bail application has been filed under Section 439 of Cr.P.C. on behalf of the petitioner who is in custody in connection with F.I.R. No. 10/2018, Police Station Falasiya, District Udaipur for the offences under Sections 363, 366, 376 & 344 of I.P.C. and Sections 4, 6 & 18 of POCSO Act.
Heard learned counsel for the petitioner as well as learned Public Prosecutor.
Learned counsel for the petitioner submits that as per the statement of the prosecutrix “S”, no overt act has been attributed to the petitioner as the entire allegations have been levelled against Shanker, the driver, who is not the present petitioner.
I have gone through the statement of P.W. 2 - prosecutrix “S”. She in her statement has clearly stated that she had stayed in the room of the present petitioner, who had also given beating to

her. However, in her cross-examination, she has stated that Shanker, the driver, has also given beating to her. From a close examination of the statement of the prosecutrix “S” (P.W. 2), it cannot be inferred that there is no involvement of the present petitioner in the commission of alleged crime and the petitioner is having no connection with the commission of the offence alleged in the present case.
Considering all aspects, this Court is not inclined to grant concession of bail to the petitioner at this stage.
Dismissed accordingly.
