Appellant has preferred this appeal aggrieved by order dated 23.01.2019 passed by Special Judge, SC/ST (Prevention of Atrocities) Cases, Baran, whereby, bail application under Section 439 Cr.P.C. filed by the appellant was rejected.

F.I.R. No. 159/2018 was registered at Police Station Anta Distt. Baran for offence under Sections 420, 406, 467, 468, 471, 366, 376, 370, 120-B of I.P.C. and Section 3(2)(V) of the SC/ST Act.

It is contended by counsel for the appellant that earlier bail was dismissed by the Court as appellant was given liberty to move fresh bail application after filing of the charge-sheet. It is also contended that charge-sheet has been filed. Co-accused Shyam Bihari and Bhagwati Prasad have been given benefit of bail. Case of petitioner is akin to that of Bhagwati Prasad.

Learned Public Prosecutor has opposed the appeal.

I have considered the contentions.

Considering the contentions put forth by counsel for the appellant, I deem it proper to allow the appeal.

The order dated 23.01.2019 passed by Special Judge, SC/ST (Prevention of Atrocities) Cases, Baran is quashed and set-aside and this appeal is accordingly allowed and it is directed that accused appellant shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/(Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.

Copy of this order be sent to the concerned Court by fax/email today itself with a direction to serve a photostat copy of the same to the appellant and an additional copy of this order be also sent to the concerned Court by ordinary process.
