Heard learned counsel for the accused-petitioner as well as learned Public Prosecutor on the application for suspension of sentence.

Learned counsel for the petitioner contends that the accused-petitioner is in custody since 27.04.2018, he was on bail during trial and pendency of the appeal. No other case is pending against him.

Learned Public Prosecutor has vehemently opposed the prayer.

Accused-petitioner has been convicted for the offences under sections 420 IPC and sentenced with simple imprisonment for one

year alongwith fine.

Without commenting upon the merits of the case, I deem it just and proper to suspend the sentence awarded to the accusedpetitioner.

Accordingly, the application for suspension of sentence is allowed and it is ordered that the sentence passed by learned trial court and affirmed by the learned Additional Sessions Judge No.3, Ajmer (Raj.) vide his judgment dated 27.02.2018 passed in Criminal Appeal No.50/2017 against the accused-petitioner Mangej Singh S/o Shri Bhanwar Singh shall remain suspended till final disposal of present revision petition provided he executes a personal bond in the sum of Rs.50,000/- along with two sureties in the sum of Rs.25,000/- each to the satisfaction of the trial court for his appearance in this Court on 01.06.2018 and, as and when called upon to do so.
