It is submitted by learned counsel for the petitioner that petitioner was posted on the post of Teacher Grade-III (Level-II). Thereafter he was selected on the post of Lecturer, Grade-I. Pursuant thereto, the petitioner was accorded posting, however on 21.08.2018, the petitioner exercised his lien on the post of Teacher Grade-III (Level-II), which was accepted and order was passed on 07.09.2018 permitting him to join back on the post of Teacher Grade-III, thereafter again the petitioner moved an application on 24.09.2018 seeking to exercise the right to be

posted pursuant to his selection on the post of Lecturer Grade-I. However, without deciding the said application, he has been relieved to join back on the post of Teacher Grade-III (Level-II) on 01.10.2018. Submissions have been made that a representation made by the petitioner is still pending, however, he has been relieved to join back on the lower post i.e. Teacher Grade-III (Level-II).

Admittedly, the order dated 07.09.2018 was passed at the request of the petitioner, wherein he exercised his lien and therefore no fault can be found in the order dated 07.09.2018. So far as the consideration of the representation made by the petitioner on 24.09.2018 is concerned, the respondents are bound to deal with the same in accordance with law.

So far as the relieving of the petitioner is concerned, in view of the contents of the order dated 07.09.2018, the petitioner was bound to be relieved and no fault can be found in the said order as well.

In view thereof, no interference is called for in the present writ petition and the same therefore, stands disposed of. Respondents are directed to decide the representation made by the petitioner on 24.09.2018 expeditiously preferably within a period of three weeks from the date a certified copy of this order is placed before the respondents.
