Petitioner is aggrieved of condition number 14 of the advertisement dated 22^nd May, 2017, inviting applications for appointment to the post of Assistant Professor/Assistant Librarian/Assistant Director (Physical Education (15600-39100AGP-6000) in various subjects as per the terms and conditions mentioned therein.

One of the conditions contemplated in the advertisement is that for the purpose of consideration of the candidature of the reserved candidates against the open category vacancies; the candidates of reserved category will have to compete on the

parameters as applicable to open category candidates. For some of the candidates of the reserved category have been included in the open category; the petitioner has instituted the present writ application.

Petitioner, present in person, submits that had the candidates of the reserved category restricted to reserved category alone; he would have been in the select list.

On being quarried-whether those reserved category candidates have been migrated to open category on merit alone or after availing of concession of reserved category/categories; the petitioner could not furnish any answer.

By now, it is well settled that reserved category candidates are entitled to compete even against the vacancies of open/general category on merits and they cannot be restricted only to reserved category quota by virtue of the fact that they being members of reserved category.

No other point was raised by the petitioner for consideration of this Court.

For the reasons aforesaid the, writ application is absloutely misconcieved, and therefore, deserves to be dismissed.

Accordingly, the writ application is hereby dismissed.

No Costs.
