Petitioner has filed this petition under Section 438 Code of Criminal Procedure, 1973 seeking anticipatory bail in F.I.R. No.66/2018 registered at Police Station Sadar, Alwar offences under Sections 420, 406, 467, 468, 471 and 120-B of Indian Penal Code, 1860.

On 21.08.2018 following order was passed by this court:-

“Learned counsel for the petitioner has handed over a cheque in the sum of Rs.10,00,000/- issued in favour of Shalini Garg and a Demand draft in the sum of Rs.6,80,000/- prepared in favour of Shalini Garg to the complainant. Photo copies of the demand draft as well as cheque have been

placed on record. Rajesh Garg (Complainant) is the husband of Shalini Garg. Rajesh Garg has accepted the cheque as well as the demand draft without prejudice to his rights with regard to the allegations levelled in the FIR.

List again on 10.09.2018. In the meantime, in the event of arrest, petitioner be released on interim bail subject to the satisfaction of the Arresting Officer. Petitioner shall abide by the conditions envisaged under Section 438(2) Code of Criminal Procedure, 1973."

Learned State counsel who is assisted by counsel for the complainant has submitted that in terms of the above order, petitioner has joined investigation.

Since, petitioner has joined investigation and has paid Rs. 16,80,000/- to the complainant, without expressing any opinion on merits of the case, interim bail granted by this Court to the petitioner vide order dated 21.08.2018, is made absolute.

Petition stands disposed of accordingly.
