Petitioner has filed this petition under Section 438 Code of Criminal Procedure, 1973 seeking anticipatory bail in F.I.R. No. 219/2018 registered at Police Station Kardhani, Distt. Jaipur Metro for offences under Sections 323, 312, 366, 376 and 506 of Indian Penal Code, 1860 (hereinafter referred as ‘IPC’)

Learned counsel for the petitioner has submitted that in terms of the last order passed by this Court dated 13.07.2018, petitioner has joined investigation.

Learned State Counsel has submitted that during investigation, it transpired that the petitioner and the prosecutrix had performed marriage and the present FIR has been lodged due to some matrimonial discord between the parties. Hence, it was found during investigation that offence under Section 376, 328, 312, 366, 506 IPC was not made out in the facts of the present

case and offence under Section 498-A IPC was made out. Now, only challan is to be presented against the petitioner under Section 498-A IPC.

Accordingly, this petition is disposed of with a direction that in case petitioner surrenders before the trial Court within ten days from today, he be released on bail subject to the satisfaction of the said Court.
