Appellant has filed this appeal under Section 14-A of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 seeking regular bail in F.I.R. No. 87/2018 registered at Police Station Roopbas, District Bharatpur for offences under Sections 323, 325, 302, 34 of Indian Penal Code, 1860 & Sections 3 (1) (r) (s), 3 (2) (V) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Learned counsel for the appellant has submitted that the appellant is in custody since 13.03.2018. Challan has already been presented in the Court and conclusion of trial may take time. Injury to deceased Sunita is attributed to co-accused Vishnu. So far as petitioner is concerned, he had allegedly inflicted injury to Bhagwan Das and the said injured has suffered simple injuries.

Appellant had also suffered injuries and had remained under treatment in the hospital.

Learned State Counsel on the other hand has opposed the appeal.

Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the appellant on bail.

Accordingly without expressing any opinion on merits of the case, this appeal is allowed. Appellant be admitted to bail subject to satisfaction of the Trial Court.
