Learned counsel for petitioners submits that prayer made in the writ petition was subject matter of order passed by this court in SB Civil Writ Petition No.7985/2014, Prahalad Lal Gupta & ors. Vs. State of Rajasthan & Anr., on 9^th November, 2016. It was subsequent to the judgment of this court in the case of Sugan Singh & Ors. Vs. State of Rajasthan & ors., SB Civil Writ Petition No.2740/2006, decided on 5^th July, 2013.

The court is now ceased of misc. application pursuant to the order of Division Bench in DB Special Appeal (Writ) No.733/2016, Radhey Shyam Sharma & Ors. Vs. State of Rajasthan & Ors.,

decided on 28^th November, 2016 thus present writ petition may be disposed of by governing it by the outcome of pending Misc. Application No.130/2015 and if such a direction is given, the petitioners would be satisfied.

I have considered the submission made by learned counsel for the petitioners.

A prayer made in the writ petition was determined by this court in the case of Sugan Singh & Ors. Vs. State of Rajasthan & ors., SB Civil Writ Petition No.2740/2006. Subsequently, misc. application was preferred by the Jaipur Development Authority as well as by others to seek clarification. The clarification was given by this court, however, it was challenged before the Division Bench in DB Civil Special Appeal (Writ) No.733/2016. The matter has been remanded to this court.

In view of the above and as agreed by the counsel, this writ petition is disposed of with liberty to the petitioners to seek its revival if pending misc. application is decided in favour of those who are not allotted the land in Prithvi Raj Nagar but in Kalpana Nagar or else where, yet this court held them entitled for allotment of land in Prithvi Raj Nagar.
