Learned counsel submits that the petitioner may be allowed to withdraw this revision giving him liberty to file an application before the trial court under Section 319 Cr.P.C. for summoning the left out accused if so advised. Learned Public Prosecutor does not object to the said prayer.
Thus, the instant revision is permitted to be withdrawn with the liberty as prayed for. In case, the complainant petitioner files an application before the trial court under Section 319 Cr.P.C. after recording of evidence, the same shall be considered and decided as per law without being prejudiced by the observations made in the order dated 11.3.2016.
