The sentence awarded to the respondents was suspended by this Court on 02.12.2016 in S.B. Suspension of Sentence(Revision) No.487/2016 and they were asked to appear before the Dy. Registrar (Judicial) of this Court on 13.01.2017 for the purpose of marking their presence.

After releasing from the jail, the respondents failed to appear before the Dy. Registrar (Judicial) of this Court on 13.01.2017 and, therefore, this Court vide order dated 20.02.2017 passed in S.B. Criminal Revision No.1349/2016 has forfeited their bail bonds and ordered to produce the respondents through warrant of arrest.

Later on, the respondent No.1 – Shishupal Yadav was arrested by the police and produced before this Court on 22.03.2017 and was sent to the jail and today he is produced in

the police custody.

However, another respondent No.2 – Jitendra Singh @ Jeetu Banna is present in the Court.

The submissions filed on behalf of both the respondents through their counsel Mr. M.S. Soni, wherein it is mentioned that after their releasing from the jail pursuant to the order of suspension of sentence dated 02.12.2016 passed in S.B. Suspension of Sentence(Revision) No.487/2016, the respondents were again arrested by the police at Jaipur on 16.12.2016 and 17.12.2016 and remained in custody up to 18.02.2017 and 20.02.2017 and, therefore, they have failed to appear for marking their presence before the Dy. Registrar (Judicial) on 13.01.2017.

In view of the reply preferred on behalf of the respondents and their sureties, the proceedings under Section 446 Cr.P.C. initiated against them are hereby dropped.
