Mahendra Singh Vs State of Rajasthan and Anr.

Learned counsel for the petitioner has contended that in this matter, the challan was filed for the offence under Sections 498A and 406 IPC. He has further contended that both the parties have entered into the compromise. On 20.7.2016, the learned court below has acquitted the accused petitioner for the offence under Sections 406 IPC on the basis of compromise, but did not attest the compromise for the offence under Sections 498A IPC. He has requested that direction should be given to the trial court that if both the parties submit a fresh joint compromise application for compounding the offence under Section 498A IPC, then the same should be attested and matter should be compounded on the basis of compromise.
